Is OKX Legal In The US?

I verified that OKX is legally allowed to operate in the United States by searching for its MSB registration on the FinCEN MSB search. You can see the results below.

Crypto exchanges are required to register with FinCEN as a Money Services Business (MSB) and secure state-by-state Money Transmitter Licenses (MTLs). This registration allows them to provide US residents with the ability to buy, sell and trade cryptocurrencies, including BTC, ETH and USDT via US banking routes.

This is the authorization route followed by other prominent crypto exchanges operating in the US, including Coinbase, Kraken, and Crypto.com.

If you’re coming from a traditional equities or futures brokerage, it’s worth understanding that crypto exchanges are not typically authorized by the CFTC or NFA, as they provide different trading products. OKX is still legally allowed to operate in the US.

Our verification of OKX INC.’s FinCEN registration. FinCEN registration should not be interpreted as federal approval or endorsement of the exchange.

However, my research into OKX’s track record in the US revealed a patchy history. In February 2025, its offshore entity, Aux Cayes Fintech Co. Ltd., pleaded guilty in the Southern District of New York to operating an unlicensed money transmitting business, and was fined over $500 million.

The core violations, which took place between 2018 and 2024, were that OKX served investors in the US through its global exchange without registering with FinCEN as an MSB. Weak compliance controls allowed US residents to bypass IP blocks and trade without satisfying Know Your Customer (KYC) identity checks, resulting in more than $5 billion in unmonitored or suspicious transactions.

OKX has since stepped up its compliance controls with stronger KYC checks and IP monitoring, with all US residents now onboarded and served through its FinCEN-registered OKX INC.

Is OKX Available In The USA?

OKX is available to most residents in the United States, with some exceptions clearly shown in our state/jurisdiction tracker below.

The states and jurisdictions it does not permit residents from, i.e. New York, Texas, American Samoa, Guam, Northern Mariana Islands, and the U.S. Virgin Islands, largely overlap with other prominent crypto exchanges. For instance, Binance restricts the same locations, while Kraken and Crypto.com block New York and island territories but do permit Texas residents, and Coinbase has specialized NYDFS licenses to operate in both New York and Texas.

What OKX Products Are (And Aren’t) Available?

Where OKX is available, US residents can expect access to spot trading and the ability to buy major and less well-known cryptocurrencies, as well as access to its Web3 Wallet, Convert, trading bots and APIs, multi-chain DeFi, token swaps, and NFTs.

What US traders do not have access to is some of the highly leveraged derivatives provided by OKX’s global platform.

What Do I Need To Open An OKX Account?

All US residents must verify their identity before they can deposit or buy crypto. This requires a valid Social Security Number (SSN), proof of a US residential address, and a government-issued photo ID, typically a passport or driver’s license.

Using a VPN cannot bypass the verification system on OKX’s restricted global platform. I tested this myself from a US IP address, and OKX would not let me through to the global site to register for an account.
